El profesor Sergio Muro acaba de
presentar su trabajo de investigación sobre derecho de quiebras en la
última reunión anual de Insol Academics, realizada en Miami (Estados Unidos) el
pasado 19 de mayo.
In this paper, I describe the historical path leading to the adoption of the new regulations and the key role played by workers’ cooperatives in that development.Then, I critically analyze the recently amended Argentine Insolvency system. Specifically, the paper suggests that the unintended result of the amendments has been to increase the pro-debtor bias the reorganization system already had. As a result, I suggest that the ambiguous amendments that the new law carries should be interpreted in such a way as to diminish that bias.
